Welcome to Bistantly. These Terms and Conditions explain the rules that apply when you use the Bistantly website, mobile applications, rider tools, merchant tools, support channels, and any related services made available by Bistantly.
Bistantly provides a technology platform that helps merchants request deliveries and helps approved riders receive, accept, manage, and complete delivery opportunities. Bistantly may also provide payment, wallet, notification, support, verification, dispute, and account management features as part of the service.
By creating an account, requesting a delivery, accepting a delivery opportunity, using the app, or continuing to access the platform, you agree to these Terms. If you do not agree, you should not use Bistantly.

Who these Terms apply to
These Terms apply to all users of Bistantly, including merchants, riders, visitors, account administrators, support users, and any person who interacts with Bistantly through the website, app, or support channels.
A merchant is a person or business that uses Bistantly to request deliveries or manage delivery activity. A rider is an approved delivery service provider who uses Bistantly to receive, accept, and complete delivery opportunities. A recipient is the person who receives an item being delivered. In some cases, a person may use more than one role on the platform, but each role may have different rules and responsibilities.

Account registration and accuracy of information
To use certain features, you may need to create an account and provide information such as your name, business name, phone number, email address, address, rider profile details, vehicle details, payout account details, and verification documents. You agree to provide information that is truthful, current, and complete.
You are responsible for keeping your login details safe. If you believe your account has been accessed without permission, you should contact Bistantly support immediately. Bistantly may suspend, restrict, or review an account where there is a reasonable concern about fraud, impersonation, account takeover, unsafe conduct, unpaid charges, policy violations, or misuse of the platform.
Bistantly may require phone, email, document, business, rider, vehicle, payout, or identity verification before certain features are available. Verification may take time and may be repeated if information changes or if security concerns arise.
Bistantly operates as a delivery technology platform. The platform helps merchants and riders connect, communicate, receive notifications, manage delivery requests, and process delivery-related information. Bistantly may also support pricing, offers, assignment, tracking, proof of delivery, wallet activity, payout processing, ratings, and support workflows.
Bistantly may update, remove, pause, or improve features from time to time. Some features may be in testing, limited rollout, or pre-launch mode. Where a feature is marked as coming soon, beta, pilot, preview, or pre-launch, it may not represent the final production version.

Merchant responsibilities
Merchants are responsible for entering accurate pickup details, recipient details, drop-off addresses, package descriptions, delivery instructions, package size, special handling notes, and any other information needed for a rider to complete a delivery safely.
Merchants must not request delivery of illegal, dangerous, prohibited, restricted, stolen, unsafe, or improperly packaged items. Merchants must ensure that items are reasonably packed and ready for pickup at the stated pickup location and time.
Merchants are responsible for ensuring that the recipient is available, reachable, and able to receive the item. If a recipient refuses the item, cannot be reached, provides wrong information, or changes delivery instructions, extra charges, delays, return delivery, cancellation, or support review may apply.
Merchants must not ask riders to perform unsafe, illegal, abusive, or unrelated tasks. Bistantly may restrict a merchant account where repeated failed deliveries, prohibited items, non-payment, abusive conduct, or misuse is detected.

Rider responsibilities
Riders are responsible for keeping their profile, vehicle, document, location, and payout information accurate. Riders must only go online when they are available and ready to receive delivery opportunities.
Riders must handle items with reasonable care, follow pickup and drop-off instructions, communicate professionally, comply with road safety rules, and complete delivery steps such as pickup confirmation, delivery OTP, proof of delivery, and any required status updates.
Riders must not demand offline payments, pressure merchants or recipients, tamper with packages, hold items unnecessarily, provide false location information, submit misleading arrival times, accept deliveries they cannot reasonably complete, or transport prohibited items knowingly.
Bistantly may pause, review, suspend, or remove rider access where there are concerns about safety, fraud, missing items, repeated complaints, false delivery status, document issues, payout risk, or violation of these Terms.

Delivery requests, offers, acceptance, and completion
A delivery request may include pickup location, drop-off location, package description, delivery preference, category, vehicle preference, estimated price, instructions, and other related details. Riders may receive delivery opportunities based on availability, location, approval status, vehicle suitability, account standing, and other matching rules.
Where the platform allows riders to submit offers, the merchant may review available rider offers, including rider name, rating, vehicle type, distance, estimated arrival time, and offer amount where available. The merchant may accept an offer or wait for other eligible riders where the feature allows it.
A delivery is not considered fully assigned until the platform confirms the rider assignment. A delivery is not considered completed until the required delivery steps are completed, which may include recipient confirmation, delivery OTP, photo proof, status update, and platform confirmation.

Pricing, fees, payments, and refunds
Bistantly may show an estimated price, rider offer price, fixed fee, variable fee, service fee, wallet debit, or payment request depending on the delivery flow. Prices may be affected by distance, urgency, rider availability, vehicle type, package size, time, location, operational rules, promotions, or other factors.
Payment must be completed through approved Bistantly channels unless Bistantly clearly states otherwise. Riders should not request offline payment from merchants or recipients. Merchants should not attempt to bypass the platform payment process where the platform requires in-app or approved payment processing.
Refunds, cancellations, adjustments, failed payments, duplicate charges, and payment disputes may be reviewed by Bistantly support. A refund or adjustment may depend on delivery status, rider assignment, pickup status, completion status, merchant error, rider error, recipient availability, payment processor rules, and platform policies.

Wallets, earnings, withdrawals, and payout accounts
Rider earnings, wallet balances, withdrawal requests, payout accounts, and payout reviews are managed through Bistantly wallet and payout systems. Bistantly may show available balance, pending balance, withdrawn amounts, transaction history, and payout status where supported.
For rider security, Bistantly may require a rider to save a payout account. A rider may have only one active payout account at a time. If a rider requests a payout account change, Bistantly may lock direct edits, pause withdrawals, and require a review period before approval.
Payout processing times may vary based on bank processing, review checks, fraud prevention, account status, public holidays, payment provider delays, incorrect bank details, or support investigation. Bistantly may reject, delay, or review a withdrawal if there is a dispute, suspected account takeover, unusual wallet activity, or incomplete verification.

Ratings, reviews, and feedback
Bistantly may allow merchants to rate riders after completed deliveries. Ratings may help merchants make informed decisions and may help Bistantly improve safety, trust, quality, and matching. Ratings should be honest, fair, and based on actual delivery experience.
Users must not submit abusive, discriminatory, false, threatening, or misleading reviews. Bistantly may remove, hide, or review ratings where there is evidence of manipulation, harassment, retaliation, fraud, or policy violation.

Prohibited items and restricted use
You must not use Bistantly to send prohibited, illegal, unsafe, stolen, restricted, dangerous, or improperly packaged items. The Restricted Items Policy forms part of these Terms. Bistantly may cancel, pause, report, or review any delivery where there is a reasonable concern about the item being transported.
Users must not misuse the platform, attack the service, scrape data, reverse engineer app systems, bypass payments, interfere with notifications, impersonate another person, submit false documents, abuse support, or use Bistantly for illegal or harmful activity.

Location, notifications, and communications
Bistantly uses location information to support pickup, drop-off, rider matching, active delivery tracking, fraud prevention, delivery confirmation, and safety-related support. Rider live location may be used while the rider is online and during active delivery workflows. More details are provided in the Location Information page.
Bistantly may send in-app notifications, push notifications, SMS, email, calls, WhatsApp messages, or other service communications for account verification, delivery activity, offers, assignments, payments, payouts, support, disputes, security alerts, and policy updates.

Suspension, restriction, and termination
Bistantly may suspend, restrict, or terminate access to the platform where an account creates risk, violates these Terms, fails verification, engages in fraud, misuses payments, submits false information, creates safety concerns, or causes repeated delivery issues.
Users may stop using the service at any time. Some records may be retained where needed for legal, accounting, fraud prevention, dispute handling, safety, regulatory, or operational reasons.

Liability and service availability
Bistantly works to keep the platform available and reliable, but the service may experience downtime, bugs, delayed notifications, failed network requests, device issues, payment provider delays, map inaccuracies, third-party service limitations, or operational interruptions.
To the fullest extent allowed by applicable law, Bistantly is not responsible for losses that arise from information entered incorrectly by a user, unavailable recipients, unsafe packaging, prohibited items, third-party service outages, bank delays, mobile network problems, device issues, or user conduct outside Bistantly control.

Changes to these Terms
Bistantly may update these Terms as the platform grows, as new features launch, or as legal, safety, payment, or operational requirements change. Where appropriate, Bistantly may notify users through the app, website, email, or other communication channels.
Continued use of Bistantly after changes become effective means you accept the updated Terms.
